This website, www.sanctumcloud.com, is run by SanctumCloud System Private Limited, 1204, B1, Westgate Business Bay, Makarba, Ahmedabad 380051, Gujarat, India ("SanctumCloud", "we", "us"). Our other company, SanctumCloud LLC, is registered in the Commonwealth of Virginia, United States. By using the website you agree to these terms. If you do not agree, please do not use it.

These terms are about the website. If you engage us for work, that engagement is governed by the proposal, statement of work, services agreement or NDA we both sign, and that contract names which of our two companies you are working with. Where those and these terms differ, the signed contract wins.

Using the website

Please use the website lawfully and fairly. You agree not to:

• pretend to be someone else, or send information that is false;
• send spam or unsolicited promotions through our forms;
• scrape, crawl or copy the website or its data without our written permission;
• try to get around its security, or upload anything harmful such as malware;
• interfere with how the website works for other people.

We may block access to anyone who misuses the website.

What the website says

We write the website to be accurate and useful, but it is general information, not advice for your situation. Prices, timelines and descriptions on the website are not offers; scope, price and timeline are confirmed in a written proposal.

Some examples on the website are marked sample. They show the kind of work we do, not a named client's project.

Strategy calls

A strategy call booked on this website is free and carries no obligation on either side. If something comes up, we may ask to move it to another time, and you can do the same. Ideas we discuss on a call are a starting point; we do not ask you to rely on them until we have agreed work in writing.

What you share with us

We treat your ideas, business information and project materials as confidential. If you would like an NDA before you share the details, ask and we sign one first. Please do not send passwords, card numbers or other secrets through our forms.

Projects with us

Every engagement is agreed in writing before work starts. That contract sets the scope, price, timeline, payment terms, ownership of the work and any refunds.

• Prices shown on the website are for information and can change; the written proposal confirms them.
• Unless the contract says otherwise, advance payments and retainers may not be refundable once work has started or people have been set aside for it.
• For SEO, marketing and growth work, we commit to doing the work well and measuring it honestly; we cannot promise a ranking, traffic level or revenue, because search engines and markets are outside anyone's control.

Content and ownership

The website and its content (text, design, graphics, logos, images, video and code) belong to SanctumCloud or the people who license them to us. You may share links to it and use it for your own reference, but not copy, republish or sell it without our written permission.

What we build for a client (its code, designs and documents) belongs to the client as the signed contract sets out.

Job applications

Applying for a role on this website does not create a job offer or a contract. You receive an email confirming that your application arrived, and we write to you if your experience fits the role. We never ask candidates for money at any stage; if anyone does in our name, it is not us, and we would like to know.

Other websites

The website links to other websites and tools, such as Google Calendar and our social media pages. We do not control them and are not responsible for their content or their privacy practices.

No guarantee the website is perfect

We work to keep the website available, accurate and secure, but we provide it "as is" and cannot promise it will always be uninterrupted or free of errors.

Limits on our liability

As far as the law allows, SanctumCloud is not liable for any indirect, incidental, special or consequential loss arising from your use of the website. Our total liability to you for the website is limited to USD 100, or the amount you paid us for access to the website in the twelve months before the claim, whichever is greater.

Nothing in these terms limits liability that the law does not allow us to limit. For work we do for you, liability is set by the signed contract.

Your responsibility

If you misuse the website, break these terms or infringe someone else's rights through it, you agree to cover the reasonable costs and claims that SanctumCloud faces as a result.

Law and disputes

These terms are governed by the laws of India. Any dispute about them is heard by the courts in Ahmedabad, Gujarat, unless a signed contract between us says otherwise. Before going to court, we ask that you write to us first at legal@sanctumcloud.com, so that we can try to put things right.

Changes to these terms

We may update these terms. The date at the top shows when they last changed, and using the website after a change means you accept it.
